General Terms and Conditions of Use

HERMÈS INTERNATIONAL, the holding company of the HERMÈS Group, publishes the website www.presse.sautHERMÈS.com (hereinafter referred to as the “Site”).

The use of the Site is subject to these General Terms and Conditions of Use (”General Terms and Conditions of Use”). On using the Site, you acknowledge that you have read, understood and accepted without reserve these General Terms and Conditions of Use.

HERMÈS INTERNATIONAL may amend and update these General Terms and Conditions of Use and the Confidentiality Policy (see Confidentiality Policy”) at any time. The General Terms and Conditions of Use and the Confidentiality Policy in force at the time of the use of the Site are those which are enforceable upon you.

We advise you to keep yourself regularly informed of the current terms and conditions. You may at any time take cognisance of the latest version of the current General Terms and Conditions of Use by clicking on the “legal notice” link.

 

1. Security and confidentiality:

The Site’s Confidentiality Policy governs the use of personal information which you agree to provide to HERMÈS INTERNATIONAL. HERMÈS INTERNATIONAL may amend its Confidentiality Policy at any time, as provided for in this document.

 

2. Intellectual Property

All the elements (drawings, models, illustrations, images, videos, soundtracks, text, logos, trademarks etc.) making up the Site shall be the exclusive property of HERMÈS INTERNATIONAL or its subsidiaries.

The “Hermès” mark, the figurative mark representing a carriage with horse, all other marks or logos linked to Hermès, whether registered or not, displayed on the Site, as well as the domain name www.presse.sautHERMÈS.com are and shall remain the exclusive property of HERMÈS INTERNATIONAL.

The use of all information, data and videos is exclusively reserved for communication purposes in relation to the "Saut Hermès 2023" event (taking place on 17th, 18th and 19th March 2023) and may not, under any circumstances, be used in any other context without the prior consent of HERMÈS INTERNATIONAL in writing.

 

3. Limitation of Liability

HERMÈS INTERNATIONAL shall in no way be held liable towards you or towards a third party for any indirect, incidental, special or other damages, including but not limited to any loss of profit or other indirect loss resulting from your use of the Site or your inability to use it. This limitation of liability applies to the fullest extent permitted by law.

 

5. Absence of guarantees

HERMÈS INTERNATIONAL cannot warrant or represent:

- that the Site is free of viruses, data overwriting programmes, Trojan horses or other destructive material;

- that the information contained in the Site is accurate, complete or up-to-date.

The Site may contain technical inaccuracies or other faults, and HERMÈS INTERNATIONAL does not warrant the correction of those faults. The Site and its content are presented on an “as is” and “as available” basis. HERMÈS INTERNATIONAL expressly excludes any form of warranty, and in particular, any implied warranty in relation to normal conditions of use of the Site or the fitness of the Site for normal or special use, its quality or adherence to all legal provisions. This limitation of liability applies to the fullest extent permitted by law.

 

6. Independence of obligations

Should any obligation laid down in these General Terms and Conditions of Use be held to be illegal, null and void, or unenforceable, this shall have no effect on the legality, validity or enforceability of the remaining obligations.

 

7. Applicable law – Disputes

These General Terms and Conditions of Use shall be governed and interpreted in accordance with French law pursuant to the Regulation (EC) 593/2008 of 17th June 2008. These General Terms and Conditions of Use are compiled in French.

In the event of a dispute linked to the use of the Site, you shall have the possibility of resorting to conventional mediation proceedings or any other alternative dispute settlement method.

In the event of a dispute, according to the provisions of Regulation No 44/2001 of 22nd December 2000:

- you may refer the matter either to the court of the place where you are residing, or else French courts;

- HERMÈS INTERNATIONAL may refer the matter to the court of the place where you reside.

HERMÈS INTERNATIONAL reserves the right to apply for and obtain injunctions or orders to defend its rights under the terms hereof.
